Correcting unjust enrichment: explaining and defending the duty to disgorge the benefits of wrongdoing

Agents sometimes innocently benefit from the wrongdoing perpetrated by others. It has been asserted that when this happens beneficiary acquires a defeasible duty to disgorge these benefits until beneficiary’s gain is extinguished or victim’s loss reversed. At same time, critics have denied existence of duties disgorgement. In paper, we contribute debate proposing novel account underlying justification, rationale, for disgorgement grounded in value corrective justice. An agent benefiting injustice disgorge, on account, because fulfilling helps correct making it as though transaction wrongfully enriched them had never happened. We go address five objections and argue justice can withstand objections.
